Simple question for you, is there an official spelling of MODX? Or is is MODx? Don't tell me both versions are fine, I at least want to know what the official spelling is or why I see it both ways all over the Internet.

I also see many different logos. I assume the one that is in this forum's logo is the most recent correct version? As I read articles and try to find information, there are many logos and I'm not sure if it means the information is no longer relevant or is out of date, or if that doesn't matter either? Is there a place to find official logos?

    Thanks!

        Hmm, thanks for the link.

This means that nearly every top trainer and website I've come across for MODX help is not only spelling it wrong (i.e. "MODx") but is also using old logos. This includes your site sottwell! Right in your main banner you spell it wrong, and don't use the registered trademark symbol either. Bob's Guides gets it right, except he never uses the registered trademark symbol.

I don't know how lenient MODX is about these things but they would do well to make sure all the nice people doing training videos and websites represent the brand properly! Heck, I'm not using the registered symbol in this post either, that would get annoying to have to paste that in every time so they aren't clear when that needs to be done.

        Thanks again

If you look at more closely at Bob's Guides, I'm sure you'll find some cases where it's spelled MODx. I'm always stumbling on ones I've missed. I think my Arvixe blog is still using the old logo too.

I hope no one will come after me for not using the trademark symbol. There are literally thousands of uses of "MODX," "MODX Evolution," and "MODX Revolution" at Bob's Guides and in MODX: The Official Guide. It would be really tedious for both me and the readers, imo, if every one had to have the trademark symbol. wink

The copyright and trademark symbols are also missing from most of the references on the Trademark page itself.

Ya, I thought that seemed odd. And they also say you can't use "modx" as part of your domain name, which is weird, cause I've never heard of a company saying they pretty much own the rights to all domain names with their name in it! After all, there is modx360.com and modxdeveloper.com etc.

I'm only bringing all this up cause I'll be writing a multi-part tutorial for a well known online site pretty soon and just want to get things right in referencing them.

AFAIK, the rule about modx in a domain name *is* enforced, though it's possible that there are exceptions with permission.

The trademark policy is the official position on how marks and names should be used.

With regard to the registration and tm symbol, they are not required by law and are typically only used to remind people of the legal status of the brand. We dropped the use in 2014 when we revised the icon/device we use in conjunction with the brand: MODX which is a US registered Trademark.

About the domain and trademark policy, we actually looked at other open source projects like WordPress, Drupal, PHP and Apache are licensed. The domain usage is explicitly permissive of usage for the promotion and growth of MODX as a platform as is the case of discovermodx.com which is a non-profit, community-driven MODX education site. Where it benefits the community, MODX may be used under the license granted within the Trademark policy. All other uses are subject to either individual license or request for removal. Over the years we have assumed a large number of domains from people who held domains that were not in compliance with the Trademark policy and license exception. While we monitor usage for violations we do not always see all of them as we're a small company with a small team and only so much time in the day.

Ultimately, the goal here is to protect the brand for both the CMS and the company that bears the name MODX. It is not to be punitive or to prevent others from being a part of the MODX ecosystem. It's just important that those companies or businesses develop their own identity and create an association that doesn't suggest official status or license without one in place. This could be abused and someone could malign the brand or create confusion in the marketplace about what's legitimate MODX "anything".

People selling services using the name MODX and it's trademarks as part of the business name or domain is not permitted as it dilutes the value of the brand and is generally done to capitalize on the brand's awareness (yes MODX is not a household name but certainly big in the CMS space). An example of how to brand a MODX related business: "modmore: more for MODX" by Mark Hamstra is completely acceptable. His own company is modmore and the "for" association is entirely permissible because it reflects purpose.

An example in another industry iSkin makes covers for iOS devices. They do not call themselves iPhone Skins, as that would not be legal, it portrays official status or licensed products.

Looking at trademark cases, the mark owner has a duty to protect the brand under most jurisdictions in order for the rights to be retained. Therefore, Apple Records, the company that first published The Beatles records had a claim over the name Apple against Apple Computers (Reference).

Trademark law is filled with grey zones and duty (related to the protection of a mark).

The official wordmark of MODX since 2011 has been all caps and is the registered wordmark in the US. We use it as such in all written communications.

Well, there's a saying that you can't teach an old bi...er, dog new tricks. I suppose in a few more years I'll have gotten into the correct habits.

Susan, of course, old habits die hard. When people write about MODX and they use an alternative form of the capitalization, we do not care at all unless it is a media outlet, in which case we will request a correction. However, there's the old saying: "You can call me anything you want, just don't call me late, for dinner." As long as people are talking about MODX, that's a good thing— even to criticise.

I've read the post a few times, but it's not terribly clear on the domain name part.

                      To quote the official page:
Using “modx” (in any form of capitalization) in a domain name is not permitted. This gets confusing fast for users and people looking for official MODX products and services. For example, the following URL would need a trademark license from MODX in order to be permitted: modxhosting.com

You seem to be saying domain names are good as long as they promote the brand and community. Wouldn't "modxhosting" be promoting the brand and community by providing quality optimized hosting for modx users??

What if someone wanted a domain like "modxtuts.com" (wink wink it's available) in order to have an open wiki-style tutorial site? Since it says you can't use "modx" in a domain name at all, then "modxtuts" would be no different than "tuts4modx" to stop any confusion about it being "official" MODX tutorials or something.
