Google provides a pretty good template for how to create a DMCA takedown notice. Ryan, maybe you should send this to The Planet as well as their payment provider?

Just keep in mind that while the description content is a copyright violation, their distributing MODx for a fee may not be a violation of the GPL. It all depends on what they’ve done to the manager code, and if they’ve clearly documented their changes and left the original copyright notices intact. They aren’t actually calling it anything else, just by a descriptive name (Ajax cms blog seo script web 2.0).

Susan, that’s my point exactly. There’s no clear GPL violation (yet) and even if there were, it’s not clear that the DMCA would apply anyhow. But since they’re stealing the images and content, there’s pretty good precedent there for a 3rd party (their hosting facility) to step in as they’re obligated to by the DMCA

They also sell Crafty Syntax, Pligg, what looks like Activecollab and
other "scripts". Mayge a joint "attack" if there is a violation of the licenses
would be good!

If this continues with the next version of MODx (0.9.7) then it’s definitely worth taking legal action IMO. For now, we should all just send him hate mail since we now know his address But I jest...

No need to be nasty or attack by any means. But if he doesn’t respond to removing MODx in its current form (copyrighted text and design) then I’ll file a formal DMCA request as Victor suggested.

I agree, by "attack" I meant to send a DMCA from all the projects he is selling...
maybe contacting the other developers and sending them together!!!
