That's an odd one. I just tried it with MODX 2.2.8 and the new user doesn't get past the Login page.
Try flushing permissions and sessions again.
Before logging back in, manually delete all files in the core/cache directory and clear your browser cache and cookies.
If that doesn't do it, my best guess is a corrupted or missing file in your install (fairly common if you used FTP to transfer the files individually). That seems really unlikely to me, but I can't think of anything else.
Maybe someone else has a better idea.
I thought that would be the case, something on the installation. It is an advanced installation, I copied the whole compressed installer to the server, decompressed via command line everything was done straight on the server. I believe I can upgrade the installation, I might try that to see if that fixes it. It is a long one I think,

I thought I would update this post with the way the problem was sorted in the end. We changed the OS from ubuntu to Read hat and MODx security works fine.
It could be an issue with the image rackspace offers for ubuntu I will just go for Red hat in future.
I couldn't find out what exactly was happening but after attempting another 20 installations, variations, config changes... changed the OS and all is good.
