Sorry I was messing around with the file path to see if it made a difference; I've sinced changed it back but still no luck...
Pie works relative to the document not the css so you need to place it in the root of your site in order for it to work in the same directory as your index.php file and make sure to update your css paths to:
.property{
url(pie.htc);
}
That should get it working.
Good luck.

Thanks benmarte
I've now got the following
.first {
border:1px solid #FFF;
border-bottom-left-radius:5px;
border-top-left-radius:5px;
border-right:none;
border-radius:5px;
behaviour:url(pie.htc);
margin-right:-5px;
padding:0 35px 0 35px;
position:relative;
z-index:97;
}
and moved it to the root (see attached)
Still not working, I must be doing something wrong, any suggestions?
I haven't been able to get pie.htc to work in MODX. I've placed the pie.htc file in every directory it could possibly route through with no joy.
However, pie.php has shown itself to work. Occasionally... It's weird because sometimes it just stops working, I haven't figured out why or when just yet. But it does work better than pie.htc.
