I'm curious about how the law applies for non-compliant web sites hosted outside the EU by non-EU citizens. Presumably you'd be breaking the law if a EU visitor visits your site, but what would be the options for enforcement?

Usually, when something this big gets passed, it's because some politically powerful group wanted it. In this case, I can't figure out who would benefit enough to make it worth the effort.

Bob, here in Europe government is an industry and it needs a constant stream of fresh topics to feed the legions of bureaucrats. Having failed to enforce ‘straight bananas’, cookies probably seemed like an easy target. Anyhow in most of Europe they ignore European laws whereas in the UK we’re an obedient bunch and try to observe the spirit of cricket. But even in the UK they’ve backed down and it’s now no longer necessary to have a pop-up to ask if you want cookies and it’s adequate to assume implied consent, that if a user is using your site they’re ok accepting your cookies, provided you have a cookie policy somewhere on site.
The EU are now turning their attention to making moustaches illegal for non-residents visiting the EU.

The cookie law is plain stupid. It is like Windows Vista prompt "Windows need your permission to continue", where you end up clicking "yes!" for everything you see on the screen.
The difference is that in Windows Vista/7, clicking "no" actually means "no". If a website doesn't ask for permission or "mistakes" you clicking no for yes, it sets the cookie anyway.
I agree with one thing tho: these cookie laws are plain stupid. Nobody benefits, businesses that need to be innovating end up spending money prepping their sites and everyone still sets cookies anyhow.
Ah I see, thank you opengeek!
