My scripts are released under different license agreements. The "DHTML Scroller" script is under its own "donationware" license as you noted.
The "HTMLHttpRequest" script is under the LGPL as it states (I link to the CC-LGPL page just to make it clearer to people who aren’t familiar with the license, as the CC folks have nice pictures explaining things; the text of the license is the same). So you can use it however you want as long as any changes are LGPL’d too -- I don’t see how the LGPL would be a problem for use in a CMS. If you do want it under another similar Free Software license like the GPL or OSL, drop me an email and I’ll license it that way.
I think the problem on the forum is that you are talking about the two different scripts . Personally I would ignore the "DHTML Scroller" script as the HTMLHttpRequest script is newer and designed to supercede it now that all browsers support "overflow: auto" on elements.
