Is this bug really still open after almost a year? Or has it been fixed in some beta somethingorother? I must say: It’s rather annoying to have all of my old pages show up as valid when they don’t exist...
Fixed in betas of 0.9.5, I believe.
I am experiencing this problem in 0.9.6. RC-3. Am I not setting something up correctly?

If you go directly to the URL your 404 is found at, it’s not going to return a 404 response, because that is found. Other URLs which do not get found should be forwarding their responses to the 404 page, and return the 404 header response, at the original URL. Your site seems to be redirecting all bad responses to the 404 URL with 200 response...??? Must have a plugin that is doing this invalid redirects...
I have SEO Strict installed. Let me disable that and see what response I get . . .
