This would be enough to make me have second thoughts about developing that: http://www.microsoft.com/maps/product/terms.html wink

With Microsoft considering Commercial Use to be that covered in the list below, you could get around those quite easily as a developer/designer by either offering the Map page for free as part of a package to clients, or even charging them for the coding and making sure you make your client aware of the fact that both MODx and Bing maps API are free and are not part of any fees you charge them yourself, giving them a copy of the relevant disclaimers/warranties/licenses as well. Neither of those cases would clash with the following terms as far as I can see.

        • Licensing or selling Applications that use or access the Service; or
        • Offering goods or services for a fee through your Application, or promoting locations at which such goods or services are offered.

You can’t sell the application (MODx) as it’s GPL anyway, and you’re not licensing it to clients - you’re giving it to them.

Not sure if that was the part you were referring to? Smoeone else feel free to stop me if I’m totally wrong laugh

Where do people get the idea you can’t sell GPL software? Of course you can. I can put MODx on a CD or make it available on my site for download and charge whatever I want for it if I want to, and anybody is dumb enough to buy it from me at my price! The only "catch" is that I have to provide the source, and the buyer can do whatever he wants with it, including make it a free download on his site.

When we speak of free software, we are referring to freedom, not
price. Our General Public Licenses are designed to make sure that you
have the freedom to distribute copies of free software (and charge for
this service if you wish), that you receive source code or can get it
if you want it, that you can change the software or use pieces of it
in new free programs; and that you know you can do these things.
You may charge a fee for the physical act of transferring a copy, and
you may at your option offer warranty protection in exchange for a fee.

Some of my clients offer goods and services for a fee and they do it through the application. IMO, that makes them commercial users.

Add to that the fact that MS is free to change the terms any time they like and I get no source code.

Mind you, I’m not saying creating a MODx interface shouldn’t be done, just that I’m probably not going to be the one to do it. In addition to the problems mentioned above, working on interfaces to MS products before has made me gun shy. wink

              Your welcome Gus!

I agree. It seems that Bing usually has morning or noon-shoots while Google has more afternoon-shoots. This makes Bing’s images more clear since they lack the shadows of the latter.

And the Birdview is amazing. What is even cooler is that they’ve cooperated with other countries so you can use the same function in places like Stockholm, Paris, London, Monaco, Marbella, Rome…
