W3C validation problem only in MODx

Hi everybody! I have made my template UTF-8 W3C valid XHTML 1.0 Strict but if I copy exactly the same code into MODx template without making absolutely ANY changes it says:

Sorry! This document can not be checked because on line 510 it contained one or more bytes that I cannot interpret as utf-8 (in other words, the bytes found are not valid values in the specified Character Encoding). Please check both the content of the file and the character encoding indication. The error was: utf8 "\xA9" does not map to Unicode.

Take a look at the character encoding set in (Tools | Configuration | Site tab).

I still tried to get it into UTF-8 (as I get somehow feeling it’s better for seo or whatever what else - I may be wrong) but it didn’t work out so I changed MODx to iso-8859-1 and it’s all good now except two elements (three errors) I just copy/pasted from MODx sample template came with it’s installation:
