That should be fine. I also have an XHTML site with a favicon served as image/x-icon and it works fine. The only other suggestion I have for you is to check that the favicon.ico file is really in ico format (and not plain bmp or something like that but with a different extension). You could use Gimp to save it as .ico to check. It makes valid .ico files, and it will also include images of different sizes and resolutions for you if you include them as different layers.
