Simplesearch is ignoring the contexts setting

Why is SimpleSearch ignoring my context settings? my call looks like:
```
[[!SimpleSearch? 
	&andTerms=`0` 
	&searchStyle=`partial` 
	&containerTpl=`search.SimpleSearchWrapperTpl`
	&currentPageTpl=`search.SimpleSearchCurrentPageTpl`
	&pageTpl=`search.SimpleSearchPageTpl`
	&tpl=`search.SimpleSearchResultTpl`
	&pagingSeparator=``
	&highlightResults=`1`
	&perPage=`[[++simplesearch_results_limit]]`
	&contexts=`French`
]]
```
no matter how I set the &contexts it always returns results from both the English & French context [and if you are logged in as an admin, from the internal context as well!]

why? how to fix?
